Ending a tenancy early and understanding break clauses after the English reforms

Identify the agreement that applies now

Do not start by searching an old template for a break clause. From 1 May 2026, ordinary assured tenancies in England, including most former ASTs, became assured periodic tenancies with no end date. An old “12-month tenancy” entry no longer determines the duration of an ordinary APT by itself. See the current guidance ↗.

Different rules may apply to resident-landlord arrangements, some halls, special agreements and other UK nations. Establish the accommodation type, start date, all named tenants, rent due date and notice wording. If unsure, have a housing adviser check the agreement before serving notice.

Giving notice for an English APT

A landlord cannot require more than two months. Where no period is specified, give at least two months; a shorter agreed period may apply. The ending date must be a rent due date or the day before it. Give notice in writing, for example by letter, email or text, and retain evidence. See how to end your tenancy ↗.

For an agreement starting before 1 May 2026, a shorter existing notice period may survive. This depends on whether it was periodic from the start, when any fixed term ended and what the agreement says about continuation. If you must leave sooner

Ask for written agreement to end earlier or shorten notice. Record when liabilities end, final rent, key return, deposit arrangements and agreed costs. Moving out and handing over keys without a clear agreement do not necessarily end rent liability.

Rent normally continues during notice. Insufficient notice can result in a permitted payment within the applicable rules, rather than any “penalty rent” the agent announces. Joint tenancies and replacing a tenant

Under a joint agreement, one tenant's notice can usually end the tenancy for everyone. Discuss it with housemates first; this differs from a separate room agreement. If all tenants and the owner agree, a properly documented replacement can allow the tenancy to continue.

A new occupant transferring a deposit share to you is insufficient by itself. Obtain written release of the departing tenant, agreement on the contract's occupants and correct deposit records. If you change your mind after giving notice, you cannot automatically stay: the landlord must agree and joint tenants also matter. Check the dates before booking the move to avoid an unexpected overlap between two rent commitments.
