Overused holiday and deductions from final pay

The annual allowance displayed in a booking system is not necessarily all earned by the date you leave. Establish the start of your leave year, annual entitlement, termination date and days or hours already taken. The employer calculates the relevant entitlement for the part-year. Do not confuse the calendar year, tax year and company holiday year. Check how bank holidays are treated: they may form part of the overall allowance. Irregular-hours work and additional contractual holiday may need a different calculation from simply dividing an annual number of days.
When a deduction is possible
If you have taken more than your entitlement at the leaving date, the employer can deduct the excess from final pay when this was agreed in writing beforehand, for example through a payback clause. A negative balance alone does not replace that agreement. See Acas on holiday when leaving ↗.
Ask payroll to identify the contractual provision and show the calculation: entitlement accrued, holiday taken, difference, pay rate and resulting amount. Permission to take holiday in advance and permission to recover its cost should not automatically be treated as the same document.
Checks before your final day
Create a dated list of leave and compare it with the employer's records. Check cancelled requests, sickness, partial days and changes to your working pattern. If you have unused holiday entitlement when employment ends, it must be paid in your final pay.
Discuss whether remaining days can be taken during your notice period. Do not simply book yourself off: approval or the appropriate notice under the applicable arrangements is still necessary. Any change to the employment end date should also be confirmed in writing because it affects the calculation.
If final pay is wrong
Obtain your final payslip ↗ and a breakdown of deductions. Send payroll a concise query with your table and the specific point you dispute. If the error remains, use the grievance procedure and seek advice from Acas ↗ in England, Wales or Scotland.
Do not let an internal email exchange continue indefinitely without checking wage-claim deadlines. Northern Ireland has a separate employment dispute procedure. Save your own relevant documents before access to the employee portal ends, while respecting employer and customer confidentiality.
